A Notice of Possible Quorum is posted whenever a quorum of members of a governmental body may assemble in an informal setting, such as a social occasion. These gatherings are subject to the Open Meetings Act (the Act) under Texas Government Code, Chapter 551 ONLY if a quorum of members engage in a verbal exchange about public business or policy. The purpose of the Notice of Possible Quorum is to provide compliance under the Texas Open Meetings Act.
However, the events described in a Notice of Possible Quorum are not considered "meetings" under the Act if the event is a "social function unrelated to the public business that is conducted by the body, the attendance of a quorum of a governmental body at a regional, state, or national convention or workshop, ceremonial event, or press conference, or the attendance by a quorum of a governmental body at a candidate forum, appearance, or debate to inform the electorate, if formal action is not taken and any discussion of public business is incidental to the social function, convention, workshop, ceremonial event, press conference, forum, appearance, or debate" (OAGTX Open Meetings Act Handbook, 2024).
